In the past, the court has followed the Rules of Court of the Supreme Court of British Columbia. However, those Rules do not always fit the Yukon context and the practice has evolved to issue Practice Directions to make changes or adjustments. In 2005, the court decided to create Rules of Court specifically for the Supreme Court of Yukon using the current British Columbia Rules of Court as a guide. Thus, these Rules of Court are similar to the British Columbia Rules of Court, although with some significant changes.
Introduction. | |
| Description of reforms | |
| The Rules of Court for the Supreme Court of Yukon came into force on September 15, 2008, ending the use of the BC Rules of Court in the jurisdiction. Rule-making authority is given to the judges of the Supreme Court under s. 38 of the Judicature Act, R.S.Y. 2002, c. 128. To this end, the judges established a Rules Committee and undertook an extensive consultation process with the members of the Bar to adapt the BC Rules for implementation in Yukon. | |
